NTTC Applauds FMCSA’s Five Year Extension of  Rear Pulsating Lamp Exemption
 
The National Tank Truck Carriers (NTTC) today acknowledged the Federal Motor Carrier Safety Administration’s (FMCSA) formal decision to extend NTTC’s exemption for the use of rear pulsating lamps on tank trailers. The exemption, originally granted in 2020, has been extended for an additional five years and is now effective through October 8, 2030.
 
This exemption pertaining to section 393.25(e) of the FMCSRs permits motor carriers operating tank trailers to install a red or amber brake-activated pulsating lamp in the upper center or upper dual outboard position on the rear of their trailers. FMCSA previously determined that this configuration is likely to provide a level of safety equal to or greater than what is required under current regulations.
 
Due to the ongoing federal government shutdown, the exemption renewal has not yet been published in the Federal Register. FMCSA will submit the approving documentation for publication in the Federal Register once the Office of the Federal Register reopens. Importantly, FMCSA’s extension is published online via FMCSA’s Exemptions webpage under “Part 393 – Parts and Accessories Necessary for Safe Operation.” FMCSA advises carriers using the exemption to keep a printed or digital copy of the exemption from the FMCSA website to assist with potential roadside inquiries.
