South Dakota Issues Hours of Service Waiver for Fuel Hauling

On October 26, South Dakota Governor Kristi Noem issued a temporary Hours of Service Waiver to combat low inventories of liquid products including gasoline, diesel, jet fuel, propane, ethyl alcohol, natural gasoline, diesel exhaust fluid, and anhydrous ammonia.

South Dakota Executive Order 2022-09 declares an emergency and that the transportation and delivery of the aforementioned products into and within the state is exempt from hours of service regulations, although fatigued drivers are not permitted to operate a vehicle. Size and weight requirements, as well as additional federal regulations, still apply. The Executive Order is set to expire no later than midnight on November 25.

South Dakota’s Public Utilities Commission this week stated that high global demand for natural gas, combined with higher U.S. export due to the Ukrainian conflict, are contributing to low inventory and high prices.

NTTC staff will continue to monitor these and other emergency declarations, and will broadcast updates when available.
