FMCSA Issues Emergency Declaration for the Production and Distribution of Baby Formula

The Federal Motor Carrier Safety Administration (FMCSA) has issued Emergency Declaration No. 2022-005, addressing emergency conditions across all 50 states and the District of Columbia for the immediate transportation of baby formula, baby formula containers and packaging, and baby formula ingredients.

Emergency Declaration No. 2022-005 states that motor carriers and drivers providing direct assistance to the national emergency are granted emergency relief from 49 CFR § 395.3, maximum driving time for property-carrying vehicles, subject to some restrictions and conditions. It is important to note that this declaration specifically cites ingredients including (but not limited to):

Whey
Casein
Corn syrup
Hydrolyzed protein

FMCSA’s declaration specifically states that direct assistance does not include routine commercial deliveries, including mixed loads with a nominal quantity of qualifying emergency relief added to obtain the benefits of this emergency declaration. The declaration is set to expire June 30, 2022 unless it is modified. Additional details can be found by clicking here.
